Conditions
Our main brochure provides the information and conditions upon which
a contract is established between Koala Travel Limited, referred
to as "Chalet Koala", and the client. Koala Travel Ltd
accepts no responsibility if the client has not read the brochure.
1. Contract. No contract shall exist between the
client, which expression shall include all persons on whose behalf
the client books, and Koala Travel Ltd until a booking form signed
by the client with deposits or full payment as applicable has been
received and accepted by Koala Travel Ltd.
The client must notify Koala Travel Ltd within 7 days of the date
of confirmation invoice if it does not accurately confirm the client's
reservation, failing which the client shall be bound by the terms
and conditions of the confirmation invoice.
Verbal descriptions, assurances and agreements can seldom be confirmed
or amicably clarified in subsequent disputes and for this reason
Koala Travel Ltd does not accept liability for them. Clients wishing
to include such items within the contract should confirm them in
writing. Acceptance will be established on despatch of written confirmation
by Koala Travel Ltd.
The contract made is subject to English law and to the exclusive
jurisdiction of the English courts. Payments due under the contract
are to be made to Koala Travel Ltd's office at Koala Travel Ltd,
46 Alston Drive, Bradwell Abbey, Milton Keynes, MK13 9HB, United
Kingdom . Koala Travel Ltd and the client accept that litigation
arising from this contract shall be conducted at a County Court
nominated by Koala Travel Ltd.
2. Children. Children under the age of 18 years
are accepted on condition that they remain the responsibility of
their head of family or, in his/her absence, the person signing
the booking form. Where children's ages are quoted in this brochure,
the age is assessed as at the date of arrival in their holiday resort.
3. Holiday price and contract. The holiday price
includes the provision of all items specified on the "Booking
Information" page, together with all extras and special requests
detailed on the client's booking form and confirmed on Koala Travel
Ltd's confirmation invoice.
4. Booking. All bookings must be made on the booking
form and must be accompanied by a £90 deposit per person per
week (£50 per child under 2 years) and full insurance premiums
if Koala Travel Ltd insurance is taken. If booking within 10 weeks
of departure, the client must forward the full costs of the holiday
with the form. Koala Travel Ltd will then send confirmation which
acts as acceptance of booking in accordance with these conditions.
5. Paying the balance. The full price of the holiday
must be paid to Koala Travel Ltd at least 10 weeks prior to departure
date. If full payment is not made at least 10 weeks prior to departure
date, Koala Travel Ltd reserves the right to cancel the booking,
retain the deposit and apply the cancellation charges set out in
condition 7 below.
6. Amendments. All amendments must be submitted
in writing by the person signing the booking form.
If a client is prevented from taking the holiday for reasons normally
allowed in Koala Travel Ltd's own client insurance cancellation
cover, the client may transfer his/her booking to a person who satisfies
all the conditions applicable to the package and who is acceptable
to Koala Travel Ltd. The client must give a minimum of 21 days notice
of his/her intention to transfer, and pay an administration fee
of £25. The transferor and transferee shall be jointly and
severally liable to Koala Travel Ltd for the payment of all outstanding
costs.
Insurance premiums are non-refundable and non-transferable.
Once the holiday contract is established, Koala Travel Ltd will
try to ensure that no amendments are required. However, because
the arrangements are planned many months in advance, changes may
sometimes be necessary. Where a significant change is made, the
client will be informed on booking, or, if already booked, as soon
as possible. The client may then:
a) accept the change, or
b) book any other available date
c) cancel the booking and receive a full refund of all money paid.
7. Holiday cancellation. Koala Travel Ltd client insurance covers
cancellation for reasons specified in the policy. If the client
cancels the holiday in respect of any or all of the persons registered
on the booking form, a charge will be made which varies with the
timing of receipt or written cancellation notice signed by the client
who signed the booking form. The cancellation refund takes into
account credit for taxes.
The percentage of the holiday cost forfeited is:
More than 70 days deposit
29 to 70 days 30% or deposit whichever is greater
15 to 28 days 50% or deposit whichever is greater
7 to 14 days 75% or deposit whichever is greater
less than 7 days 95% or deposit whichever is greater
Insurance premiums are non-refundable and non-transferable.
8. Client's behaviour. The client undertakes to
behave in an orderly fashion and not to disrupt the enjoyment of
others on holiday with him/her or to prejudice Koala Travel Ltd's
reputation with the owners of accommodation or suppliers. The holiday
of any client in breach of this clause shall be terminated forthwith
and Koala Travel Ltd shall have no further contractual obligations
towards him/her.
9. Damage. Clients liable for all damage caused
by their action or the actions of children for whom they are responsible.
Reiumbursement must be made to the Koala Travel Ltd representative
before leaving the resort. Koala Travel Ltd's optional client insurance
scheme covers against third party risks.
10. Smoking. Koala Travel Ltd operates a no smoking
policy.
11. Refunds. No refunds can be made for unused
portions of unused accommodation or services.
12. Accuracy. The descriptions in this brochure
have been carefully researched and are given in good faith based
upon information provided to Koala Travel Ltd.
Koala Travel Ltd. reserves the right to make changes to the particulars
within this brochure at any time after publication, but in doing
so will comply strictly with all relevant laws and codes of conduct.
Koala Travel Ltd. will not be held responsible for any loss, delay
or costs associated with adverse weather conditions.
